Legal Issues for Poets and Publishers

Poets and publishers are confronted with a number of legal issues, including intellectual property rights and estate planning issues, often without realizing it. Poets need to be aware of the panoply of rights they have in their works so that they may adequately protect them, both now and in the future. Relatedly, publishers need to understand what rights they are obtaining when they agree to publish an author's work. Common issues include: What exactly is copyright and how does it apply to poets and publishers? When can a writer publish the same poem in more than one publication? What rights do workshop participants have in the other participants' draft works? Can a publisher sell broadsides or other items with published works on them?
